Welcome to microdose-tracker.com (the "Site"). These Terms of Service (the "Agreement") apply to any access to or use of the Site and its services. The Site is owned and operated by Adult in Training, located at 785 N Water St, South Elgin, IL 60177.

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING OR ACCESSING THE SITE. BY USING OR ACCESSING THE SITE, YOU SIGNIFY YOUR ASSENT TO THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. IF YOU DO NOT ASSENT TO THIS AGREEMENT, PLEASE DO NOT USE OR VIEW THE SITE.

1. Eligibility and Age Requirement

You must be at least 18 years of age to use this Site. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. If you are under 18, you may not use or access this Site under any circumstances.

2. Changes to Agreement

Adult in Training may, at any time and in its sole discretion, amend, modify, delete or add (collectively "Amendments") to the terms and conditions of this Agreement. We will provide notice of material changes by posting the updated Agreement on this page and updating the "Last updated" date. Your use of the Site after such Amendments have been posted constitutes your agreement with and acceptance of such Amendments.

3. Changes to Site and Services

Adult in Training may, at any time and in its sole discretion, modify, add to, delete, suspend or terminate the Site and any content, services or material offered on or through the Site, for any or no reason, and with or without notice.

4. Description of Service

Microdose Tracker is a web application that allows users to:

  • Access educational information about microdosing practices
  • Track and log personal microdosing experiences over time
  • Monitor trends in self-reported wellness metrics
  • Receive optional reminder notifications

The service is provided for personal tracking and informational purposes only.

4.1 Service Availability

We do not guarantee that the Site will be available at all times or that access will be uninterrupted or error-free. We reserve the right to suspend or discontinue the Site at any time without notice. We shall not be liable for any modification, suspension, or discontinuance of the Site.

5. Intellectual Property Ownership

All information, materials, images, software, photographs, articles, functions, text and other content (collectively, "Content") contained on or offered through the Site and all copyrights, trademarks, and other intellectual property rights in or relating to the Content are the sole property of Adult in Training, its licensors or content providers.

Content may not be copied, reproduced, republished, uploaded, posted, transmitted, displayed, performed, distributed or used in any way without Adult in Training's prior written permission; provided however, that users may download one copy of any Content on any single computer and print a copy of that Content solely for their personal, private, non-commercial use.

6. User Accounts and Data

To use certain features of the Site, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You retain ownership of the data you submit to the Site (your "User Data"), including your tracking logs and personal information. By using the Site, you grant Adult in Training a limited license to store, process, and display your User Data solely for the purpose of providing the services to you.

6.1 Data Export and Portability

Upon termination of your account or at any time upon request, you may request a copy of your User Data in a portable format. Requests should be made within 30 days of account termination. After this period, your data will be permanently deleted in accordance with our Privacy Policy.

6.2 Account Inactivity

We reserve the right to delete accounts that have been inactive for more than 24 months. We will provide notice to the email address on file at least 30 days before deletion.

7. User Submissions and Conduct

You agree not to post on or transmit to the Site any material that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Is false, misleading, or constitutes an unfair or deceptive practice
  • Infringes on any third party's intellectual property or proprietary rights
  • Contains viruses, malware, or other harmful code
  • Violates any applicable local, state, national, or international law

8. NO MEDICAL ADVICE — IMPORTANT DISCLAIMER

THE SITE OFFERS HEALTH, WELLNESS, AND EDUCATIONAL INFORMATION, BUT SUCH INFORMATION IS DESIGNED FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

THE INFORMATION CONTAINED ON THE SITE DOES NOT AND IS NOT INTENDED TO CONVEY MEDICAL ADVICE AND DOES NOT CONSTITUTE THE PRACTICE OF MEDICINE. YOU SHOULD NOT RELY ON THIS INFORMATION AS A SUBSTITUTE FOR, NOR DOES IT REPLACE, PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

We do not recommend, endorse or make any representation about the efficacy or suitability of any specific practices, products, procedures, treatments, or other information that may be contained on or available through our Site. Adult in Training bears no responsibility for any damages, illnesses, or other potential risks associated with any practices discussed on this Site. Any actions taken in reliance upon shared advice or information are executed at the user's own risk.

9. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THIS SITE AND ANY PRACTICES DISCUSSED HEREIN ARE UNDERTAKEN AT YOUR SOLE RISK.

You assume full responsibility for any consequences arising from your decisions and actions related to microdosing or any other practices referenced on this Site. This includes, but is not limited to:

  • Physical or mental health effects
  • Legal consequences in your jurisdiction
  • Social or professional consequences
  • Any other direct or indirect results of your choices

Adult in Training makes no guarantees regarding outcomes from any tracking, protocols, or information provided through the Site.

10. Legal Status of Substances

IMPORTANT: The legal status of psilocybin, LSD, and other psychedelic substances varies by jurisdiction. Many of these substances are classified as controlled substances in numerous countries and states.

This Site does not encourage, promote, or facilitate the acquisition, possession, or use of any illegal substances. The information provided is for educational and harm reduction purposes only.

You are solely responsible for understanding and complying with all applicable laws in your jurisdiction. Adult in Training accepts no liability for any illegal activities conducted by users of this Site.

12. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to our collection and use of personal data as outlined in the Privacy Policy.

We implement reasonable security measures to protect your data, but no method of transmission over the Internet or electronic storage is 100% secure. You acknowledge that you provide your personal information at your own risk.

13. Electronic Communications Consent

By creating an account, you consent to receive electronic communications from us, including:

  • Account-related emails (verification, password reset, security alerts)
  • Reminder notifications (if enabled)
  • Service updates and announcements
  • Responses to your inquiries

You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You may opt out of non-essential communications at any time through your account settings.

14. Feedback and Suggestions

Any feedback, suggestions, ideas, or other information you submit to us ("Feedback") becomes our property. We may use such Feedback for any purpose without compensation or attribution to you. You waive any rights you may have in such Feedback.

15. Disclaimers and Limitation of Liability

While Adult in Training uses reasonable efforts to include accurate and up-to-date information on the Site, we make no warranties or representations as to its accuracy.

THE MATERIALS ON THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ADULT IN TRAINING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
IN NO EVENT WILL ADULT IN TRAINING BE LIABLE TO YOU FOR DAMAGES OF ANY KIND INCLUDING WITHOUT LIMITATION ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES RESULTING FROM OR IN CONNECTION WITH THE SITE, ITS CONTENT, OR ANY ERRORS OR OMISSIONS IN THEIR TECHNICAL OPERATION OR CONTENT, EVEN IF ADULT IN TRAINING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you. In such cases, our liability shall be limited to the maximum extent permitted by law.

16. Indemnification

By using the Site, you agree to indemnify, hold harmless and defend Adult in Training and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to attorneys' fees, resulting directly or indirectly from:

  • Your use of the Site in violation of this Agreement
  • Your violation of any third-party rights
  • Your violation of any applicable laws or regulations
  • Any content you submit to the Site

17. Third Party Sites and Content

The Site may contain links to websites maintained by third parties over whom Adult in Training has no control. We accept no liability or responsibility for any material supplied or contained on such third-party sites. We make no representation or warranty as to the accuracy or any other aspect of the information on such sites. Your use of third-party sites is at your own risk.

18. Dispute Resolution and Arbitration

18.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at info@adultintraining.us and attempt to resolve the dispute informally for at least 30 days.

18.2 Binding Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association ("AAA"), rather than in court.

Illinois Uniform Arbitration Act: This arbitration agreement is made pursuant to a transaction involving interstate commerce and shall be governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and, to the extent not preempted, the Illinois Uniform Arbitration Act, 710 ILCS 5/1 et seq.

Arbitration Procedures:

  • The arbitration shall take place in Kane County, Illinois, unless you and Adult in Training mutually agree otherwise
  • The arbitration shall be conducted by a single arbitrator
  • The arbitrator's decision shall be final and binding
  • Judgment on the arbitration award may be entered in any court of competent jurisdiction
  • Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines otherwise

Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to info@adultintraining.us within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration provision.

18.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.

18.4 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court in Kane County, Illinois (or the county where you reside) for disputes within the court's jurisdictional limits.

18.5 Injunctive Relief Exception

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

19. Illinois Consumer Protection

19.1 Illinois Consumer Fraud and Deceptive Business Practices Act

We are committed to complying with the Illinois Consumer Fraud and Deceptive Business Practices Act, 815 ILCS 505/1 et seq. We will not engage in any unfair or deceptive acts or practices in connection with your use of this Site.

19.2 Your Rights Under Illinois Law

Nothing in this Agreement shall be construed to limit any rights you may have under Illinois consumer protection laws. If any provision of this Agreement is found to violate Illinois law, that provision shall be modified to the minimum extent necessary to comply with Illinois law, or if modification is not possible, shall be severed from this Agreement.

If you believe we have engaged in unfair or deceptive practices, you may file a complaint with the Illinois Attorney General's Consumer Protection Division:

20. Termination

Adult in Training may terminate your access to the Site at any time, with or without cause, with or without notice. Upon termination, your right to use the Site will immediately cease.

You may request deletion of your account and associated data at any time by contacting us or using the account deletion feature in your settings. Upon deletion:

  • Your personal data will be removed within 30 days
  • You may request a data export within this 30-day period
  • Anonymized data that has already been aggregated for research purposes will not be deleted

21. Force Majeure

Adult in Training shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:

  • Acts of God, natural disasters, or severe weather
  • War, terrorism, riots, or civil unrest
  • Government actions, embargoes, or sanctions
  • Epidemics or pandemics
  • Power outages or telecommunications failures
  • Cyberattacks or security breaches beyond our reasonable control
  • Strikes or labor disputes

22. Governing Law and Jurisdiction

This Agreement shall be governed by, and construed and enforced in accordance with, the laws of the State of Illinois, United States, without regard to its conflicts of law principles.

Subject to Section 18 (Dispute Resolution and Arbitration), any dispute not subject to arbitration shall be brought exclusively before the state or federal courts located in Kane County, Illinois, and you consent to the personal jurisdiction of such courts.

23. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent that you are not located in, under the control of, or a national or resident of any country to which export of our services is prohibited.

24. Severability

If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent.

25. Entire Agreement

This Agreement, together with our Privacy Policy, represents the entire agreement between Adult in Training and users of the Site relating to the subject matter contained herein. No delay or failure by Adult in Training to take action under this Agreement will constitute a waiver of any of the provisions contained herein unless expressly waived in writing.
